Introduction

At Georg Jensen, we know that you care about the protection of your Personal Information, including the personal details you provide for your membership to the Georg Jensen customer club, My Georg Jensen. Naturally, we want to meet your expectations and respect your wishes, and have developed My Georg Jensen to fulfil your needs.

We operate My Georg Jensen with the aim of giving you the best possible service both in our stores and on our website georgjensen.com/en-au.

My Georg Jensen in Australia and New Zealand is run by Georg Jensen Pty Ltd ABN 78 000 773 633 (in these Terms of Membership, referred to as “Georg Jensen”, “we” or “us”).

Personal Information you provide for your membership to My Georg Jensen is controlled by Georg Jensen Pty. Ltd.

Any Personal Information you give us as part of your My Georg Jensen membership is treated in accordance with these Terms of Membership (“Membership Terms”) and, as applicable, the Privacy Act 1988 in Australia and the Privacy Act 1993 in New Zealand. For further details on the meaning of “Personal Information” and our privacy practices, please see our Privacy Policy.

We recommend that you keep a printed copy of these Membership Terms.

Your use of our website and services is subject to these Membership Terms, our general terms and conditions of trade (including our Exchanges and Returns Policy), Privacy Policy and Cookie Policy, which apply at all times. You are responsible for staying up to date with these Membership Terms. The current version of each of the above documents can be found on georgjensen.com/en-au and georgjensen.com/en-nz.

Membership and Acceptance

Membership of My Georg Jensen requires your acceptance of these Membership Terms and/or your consent to us collecting and processing your Personal Information as described in these Membership Terms.

You can withdraw your acceptance of these Membership Terms at any time by terminating your My Georg Jensen membership. All you need to do is contact us - see the contact details under Contact Information.

Receiving marketing material from Georg Jensen

As a My Georg Jensen member, you may subscribe to e-mails and SMS from us containing offers and other marketing-related materials about our products. You can subscribe to such newsletters and other electronic marketing materials on your member profile. You can unsubscribe at any time by clicking the “unsubscribe” link in the communication or in your member profile.

What Personal Information do we collect and use?

When you create a member profile, you will be asked for the following information: e-mail address, country and gender.

We may also request the following information: name, telephone number, address, age, title, profession, birthday, wedding day and other special occasions, products of interest, lifestyle interests, preferred store location and/or sales assistant and jewellery sizes for you or your nearest and dearest. You do not have to provide any of this information if you do not wish to do so, however if you do not provide such information, it may impact the services that we can provide to you and your My Georg Jensen experience. We may also collect data about how you use our website and your interactions with our social media accounts.

If you login to your member profile via social media, such as from Instagram or Facebook, we may collect information from that login.

We may also collect the following to facilitate your My Georg Jensen experience:

• Information about transactions made with your registered e-mail address or phone number, including transactions made on our website and in-store (purchase history), and information that is required to make such transactions.
• Details about any payment transactions you enter into on our website, such as credit or debit card numbers, expiry dates and security codes. We use a third party payment services provider to collect this information on our behalf.
• Information about your interactions with our electronic newsletters and your page views of our online store.
• Technical data from cookies, including internet protocol (IP) address, any login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access your My Georg Jensen account.
• Personal Information you provide when you take part in a contest, answer a survey or participate in other promotional events we may sponsor from time to time. In those instances, we will inform you of the terms of participation and what Personal Information is collected as part of the competition, survey or event.

Purpose of collecting and using Personal Information

We collect and use the Personal Information you provide for your My Georg Jensen membership to:

• manage your membership;
• offer you member benefits and services;
• provide a way for you to inform us of your wishes; and
• improve our products and services.

We may also use your information to:

• communicate with you (e.g. to assist you when making an online purchase);
• organise your purchases;
• update you about new products, services and benefits;
• personalise our website for you;
• contact you as part of market surveys; and
• if you have subscribed to marketing communications, send you marketing materials and information, newsletters or other information that might be of interest to you based on your interests.

We may also use your information for statistical purposes or to meet our legal requirements.

Sharing your Personal Information

Georg Jensen Pty Ltd are responsible for protecting your rights as a data subject, ensuring the necessary security measures and use of data processors.

We only share your Personal Information with others to the extent outlined in these Membership Terms and our Privacy Policy.

We may share your Personal Information with other affiliates in the Georg Jensen group if you identify yourself as a My Georg Jensen member to those affiliates, such as if you visit Georg Jensen stores in other countries.

If you identify yourself as a My Georg Jensen member to an overseas store, the sales assistant will be able to view your profile from the e-mail address connected to your membership, including your name, telephone number, e-mail address, membership number and purchase history. When you identify yourself as a My Georg Jensen member in an overseas store by providing your e-mail address, you agree to your Personal Information being transferred to the country where that Georg Jensen store is located.

We may also disclose your Personal Information to third parties in order for us to meet our obligations to you, such as to fulfil the delivery of your orders (using external couriers).

Your Personal Information may also be shared with suppliers who deliver services on our behalf (such as for the delivery of our e-newsletters and other communications). In those instances, the use of your information by the suppliers will be subject to agreements that ensure they: (a) have put in place sufficient technical and organisational precautions to protect your Personal Information from unauthorised or illegal access, loss, misuse, interference, modification or disclosure; (b) have limited access to your Personal Information only to employees involved in providing the desired service; (c) only use your Personal Information in accordance with these Membership Terms; and (d) do not use your Personal Information for any other purpose than that associated with providing the required service or with our written instructions.

Right to access, change and delete

You may review, correct, update, change or delete your member profile information at any time. Log into your account on our website, go to your member profile and make the desired changes.

If you want to know what Personal Information we store about you, how we use your Personal Information, who receives your Personal Information or the source of that information, please contact us as per Contact Information below. If you want us to correct, update or delete your Personal Information and/or your member profile or to limit our use of your Personal Information, please contact us as per Contact Information. We will answer your query as quickly as possible and, in any case, within one month.

You are also entitled, in certain circumstances, to object to our use of your information, including our use of your Personal Information for the purposes of marketing, including profiling.

If your My George Jensen membership has been terminated, we will cease collecting your Personal Information. Your Personal Information will generally be deleted within 6 months after termination of your membership. You can request that your information be deleted at any time by e-mailing store.online.au@georgjensen.com.

Regardless of the above, we may store your Personal Information after the termination of your membership, such as for accounting reasons, to comply with our other legal requirements, or if we have to determine, make or defend a legal claim.

Passwords

You must keep your username and password protected from unauthorised disclosure or use. You should therefore not give your username or password to anyone nor save it in your internet browser via its ‘password auto-save’ function. We strongly recommend that you log out of your account each time you use it.

Changes to these Membership Terms

If we change these Membership Terms, we will contact you at the e-mail address you have provided in your member profile. We will also notify you of any changes to our website and provide the latest Membership Terms on our website at all times. The date of the Membership Terms will appear at the bottom of the page.

If you do not accept the revised Membership Terms, you must terminate your My Georg Jensen membership and stop using the member benefits and services. If you continue your membership, you are deemed to have accepted the then-current Membership Terms, unless our changes to the Membership Terms require your specific consent.
